📘 Kabukis Terms of Service

1. Introduction & Acceptance

These Terms constitute a binding agreement between Durman Marketing (trading as Kabukis), a South African company, and you (“you”, “Customer”, “User”). By registering, ordering, or using this site, you confirm you’re 18 years or older, accept these Terms fully, and agree to abide by them. If you disagree, please do not use our services.

2. Account & Eligibility

• You must create an account to place orders and manage shipments.

• You’re responsible for maintaining accurate account information and safeguarding your login credentials.

3. Orders, Pricing & Payments

• We accept card payments only, via our specified payment gateway. EFT is not accepted.

• Prices are accurate at the moment of purchase and may change without notice.

• Orders may be cancelled or refused in cases of pricing errors, lack of stock, suspected fraud, misuse of the site, or illegal activity.

4. Product Availability

• All purchases are subject to stock availability.

• We reserve the right to cancel or modify orders as necessary for the reasons above.

5. Shipping & Returns

• Our Shipping and Returns policies are integrated into these Terms. Please review them carefully before completing a purchase.

• Notify us immediately at hello@kabukis.co.za if you have any concerns with your order.

6. User Conduct & Prohibited Actions

You agree not to:

• Interfere with site functionality or security (for example, hacking or form abuse)

• Engage in fraudulent activity, forgery, spamming, or any illegal acts
  Violation of these rules may result in temporary or permanent account suspension.

7. Marketing Communications

• By creating an account, you consent to receive marketing emails, updates, and promotions.

• You can opt out of marketing communications at any time via an unsubscribe link; transactional emails (order and shipping updates) are not affected.

8. Referral Program

• We may offer a referral program where customers refer others to Kabukis in exchange for rewards (e.g., discounts or store credit).

• Eligible referrals and rewards will be clearly communicated at program launch.

• Referrals must follow any rules posted at sign-up; we may adjust or cancel the program at any time.

• Rewards are issued only for new qualifying purchases and may be revoked in cases of fraud or abuse. 

9. Affiliate Program

• We may operate an affiliate program allowing third parties (“Affiliates”) to earn commission by promoting Kabukis products.

• Affiliate eligibility, application, commission structure, payout processes, and tracking mechanisms (e.g., cookies, link attribution) will be detailed in a separate Affiliate Agreement. 

• Affiliates must not misrepresent Kabukis, use unsolicited solicitations, or infringe on intellectual property. Breaches may result in withholding payments or termination. 

10. Promotional Vouchers & Gift Cards

• Promotional vouchers, gift cards, and coupons may be offered from time to time, with specific terms (e.g., expiry date, minimum spend).

• Voucher or coupon value is applied at checkout. Purchases with vouchers are non-exchangeable for cash unless required by law.

• Fraudulent use or duplication of vouchers may result in order cancellation and legal action.

11. Intellectual Property

All site content—text, images, logos, software—is owned or licensed by Kabukis. Unauthorized reproduction or use of our intellectual property is prohibited.

12. Liability & Disclaimers

• Our liability is limited to the extent permitted by applicable law.

• We are not liable for indirect, incidental, or consequential damages, including loss of profit, data, or goodwill.

• We do not guarantee product availability, accuracy of descriptions, or uninterrupted site operation. 

13. Dispute Resolution & Governing Law

• These Terms are governed by South African law.

• If a dispute arises, please contact hello@kabukis.co.za to try amicable resolution.

• Unresolved disputes may be escalated to the appropriate South African courts, including the Gauteng High Court.

14. Changes to Terms

• We may revise these Terms at our discretion.

• Updated Terms will contain a new “Last Updated” date.

• Continued use after updates signifies your acceptance of revised Terms.

15. Account Termination

We may suspend or terminate your account, refuse orders, or revoke program memberships if you breach these Terms or misuse the site.
